OFFICIAL RULES FOR ATLANTA UNITED AMATEUR CUP, PRESENTED BY PERFICIENT
Atlanta United FC Amateur Cup Qualifier (“Challenge”)OFFICIAL RULES (“Official Rules”)
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Violation of any part of these Official Rules will, at Tournament Operator or Sponsor's (defined below) election, result in disqualification from the Challenge or forfeiture of Prize (defined below). All decisions and rulings of Tournament Organizer or Sponsor are final and binding.
DESCRIPTION: The Challenge is a one-on-one FIFA 23 video game tournament operated online or in-person via FIFA 23’s online friendlies or “Kickoff” mode.
ELIGIBILITY: The Challenge is open to legal residents who live within a seventy-five (75) mile radius from the [Mercedes Benz Stadium] located at [1 AMB Drive NW, Atlanta GA 30313] (the “Territory”) who are either at least eighteen (18) years of age and the legal age of majority in the jurisdiction in which they reside [(in the event the applicable entrant is under the age of eighteen (18), parental/legal guardian approval is required)]. Entrants must own a PlayStation 4 or PlayStation 5 gaming console with a copy of the FIFA 23, PS4 Edition video game prior to October 8, 2022. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of [Atlanta United FC] (“Sponsor” or “Prize Administrator”), Major League Soccer, L.L.C. (“MLS”), Soccer United Marketing, LLC (“SUM” and collectively with MLS, the “MLS Entities”), start.gg, OS Studios, Inc. (“Tournament Operator”), and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Challenge are not eligible to participate or win a prize. The Challenge is subject to all applicable federal, provincial, state and local laws, rules and regulations. Void outside Territory and where prohibited or restricted by law, rule or regulation.
Entrants will be ineligible if they are not:
· able to participate in the Challenge;
· able to test their equipment to ensure remote participation is feasible with Tournament Organizer;
· an Amateur. “Amateur” shall mean an entrant that has not:
o participated in an EA Broadcast within 24 months prior to the Challenge Date;
o participated in an EA Global Series Qualifier within 24 months prior to the Challenge Date;
o previously signed to an eMLS Club or any formally FIFA recognized club or organization;
o been ranked in the FIFA Global Series Rankings.
One (1) entry per person is permitted.
CHALLENGE DATE: The Challenge will be held on October 23, 2022 (“Challenge Date”). The Clock of the Tournament Organizer will be the official timekeeper for this Challenge. The Tournament Organizer will create a single elimination bracket tournament. The Tournament Organizer will randomly determine the entrants playing in the first round against each to begin the tournament matches. Each match will begin play at its designated start time. Applicable entrants are required to be in the designated gameplay area at all times. Players shall set up the match and begin play only when instructed to do so by Tournament Operator.
METHOD OF ENTRY: Prior to the Challenge Date, eligible entrants may enter the Challenge by visiting https://www.start.gg/league/emls-amateur-cup-2022 and following the relevant procedures set forth therein to enter into the Challenge.
PARTICIPATION REQUIREMENTS: In order to participate in this Challenge, each entrant must adhere to the following Challenge operational rules:
· Video Game Console Used: PS4 or PS5
· Video Game: FIFA 23, PS4 Edition
· Format: One versus one
· Bracket: Single Elimination; Best of 1
· Location: LAN or Online
· FIFA 23 Game Play Settings:
o Game Mode: Online Friendlies
§ Game mode: If Online - Online Friendlies
§ Game mode: If LAN - Kickoff Mode
o All games must be played with the following MLS club: [Atlanta United FC]
o Half Length: 6 Minutes
o Stadium: Any MLS club’s home stadium
o Tactical defending required
o Draws will be decided by a second Golden Goal match
o Trainer must be turned off
o Legacy defending is prohibited
o Difficulty Level: World Class
o Commentary Volume: 0
o Music Volume: 0
o Time/Score display: Radar: 2D
o HUD: Indicator Custom tactics are allowed
o Each entrant will have a maximum of three (3) minutes to configure controls, adjust line-ups and settings in accordance with the “Matchplay Settings” of FIFA 23 during the time period designated by Tournament Organizer prior to the applicable Challenge match. Custom lineups cannot be used, nor can anything else that is not available in the in-match pause menu.
ENTRANT CODE OF CONDUCT: Entrants must conduct themselves in a reasonable manner, maintaining a friendly and polite demeanor to the Released Parties, members of the press, and to other entrants. All players are expected to adhere to the standards of good sportsmanship. Entrants must refrain from using vulgar or offensive language, including language that is profane, sexually explicit, lewd, suggestive, unnecessarily violent, or derogatory of any ethnic, racial, gender, religious, professional or age group. Abusive behavior, including harassment and threats, is prohibited. Physical abuse, fighting or any threatening action or threatening language, directed at any entrant, official or any other person is prohibited. Any action designed to disrupt the opposing entrant’s view of the field or ability to select controlled players is prohibited.
All entrants must not disclose any confidential information provided by the Released Parties to any other people or groups of people, including via social media. No entrant may accept any gifts, rewards, or compensation for services that are promised to be rendered in connection with competing in the Challenge. The only exception to this rule is for entrants with sponsors who are paying them based on their performance. For clarity, and notwithstanding the foregoing, each entrant may not provide any third party (including any personal sponsor) any exposure during such entrant’s participation in the Challenge.
PUBLICITY: By entering the Challenge, each entrant grants (and agrees to confirm that grant in writing, if necessary) the Release Parties, and their authorized representatives, the right to use your entry, name, biographical information, likeness, image, voice, and statements for promotion, trade, commercial, and publicity purposes, at any time or times in perpetuity, in all media now known or hereafter discovered, including television, internet and social media, worldwide, without notice, review or approval and without additional compensation, except where prohibited by law.
WINNER SELECTION: At the conclusion of the Challenge, the final one (1) individual remaining that will be awarded the Prize (as defined below).
PRIZE: The winner of the Challenge (the “Prize Recipient”) will receive the following prize (“Prize”):
· One (1) seat to participate in a one-on-one FIFA 23 video game tournament hosted from October 28, 2022 to October 30, 2022 (the “eMLS Amateur Cup”).
· VIP Matchday Experience for a 2023 Atlanta United Match of the clubs discretion
Total approximate retail value of each Prize: [$500 USD].
Each Prize Recipient is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including luggage fees, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of each Prize Recipient. All Prize details are at Prize Administrator’s sole discretion.
The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Prize Administrator’s sole and absolute discretion. Prize Administrator reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion. The dates and times of eMLS Amateur Cup are determined in the sole discretion of MLS, as applicable, and may be subject to change. The MLS Entities reserve the right to remove or deny entry to a Prize Recipient who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the Challenge or any MLS event. Released Parties (as defined below) will not be responsible for weather, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other event that may cause the cancellation or postponement of any MLS Event. If Prize Recipient is unable or unwilling to participate in the 2022 eMLS Amateur Cup, such Prize Recipient will be disqualified from receiving the Prize, and at Sponsor and Prize Administrator’s sole discretion and time permitting, Prize Administrator may cause an alternate Prize Recipient to be selected from among all remaining eligible entries.
PRIZE RECIPIENT NOTIFICATION: Each potential Prize Recipient must continue to comply with the Official Rules. Prize receipt is contingent upon fulfilling all requirements set forth by Prize Administrator. Each Prize Recipient will be contacted by Prize Administrator’s following conclusion of the Challenge. In the event that any Prize Recipient does not respond to any such notification within three (3) days of the date of issuance, a disqualification will result, the Prize will be forfeited and, at Sponsor and Prize Administrator’s sole discretion and time permitting, an alternate Prize Recipient may be chosen from among all remaining eligible entries. Each Prize Recipient may be required to submit thier valid social security number (if applicable) and/or other identification to Sponsor and will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Release of Publicity, within five (5) days of date of issuance. A disqualification will result, the Prize will be forfeited and, at Prize Administrator’s sole discretion and time permitting, an alternate Prize Recipient may be randomly selected from among all remaining eligible entries if all required documents are not properly executed and returned within the specified period of time. Refusal or return of such documents as non-deliverable or Prize Recipient’s noncompliance with these Official Rules will also result in disqualification and forfeiture of the Prize and, at Prize Administrator’s sole discretion and time permitting, may cause an alternate Prize Recipient to be selected from among all remaining eligible entries.
In the event of a dispute as to the identity or eligibility of a Prize Recipient based on an e-mail address or social media account, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address or social media account submitted at the time of entry provided they are eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable ISP or other organization (such as a business or educational institution) has assigned the e-mail address or social media account for the domain associated with the submitted e-mail address or social media account. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Challenge.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Challenge, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims or cause of action against the Sponsor, MLS Entities, Tournament Operator, Prize Administrator, start.gg, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Challenge, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) arising out of participation in the Challenge or receipt or use of any Prize, including, but not limited to: (a) interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, video game platform, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer/video game platform hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, video game platform, video game software, network, typographical, printing or otherwise relating to or in connection with the Challenge, including, without limitation, errors or difficulties that may occur in connection with the administration of the Challenge, the processing of entries, the announcement of the Prize or in any Challenge-related materials, (b) incorrect or inaccurate information, whether caused by FIFA 23 or video game platform users, tampering, hacking, or by any equipment or programming associated with or utilized in the Challenge; (c) late, lost, stolen, incomplete, illegible, misdirected, damaged, garbled, delayed, or undelivered entries; (d) injury or damage to entrants’ or to any other person's video game platform related to or resulting from participating in this Challenge; (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Challenge or receipt of any Prize; (f) cancellation or postponement of the Challenge or any MLS event; (g) any travel or activity related to the receipt or use of any Prize. Each Prize Recipient, by acceptance of Prize, grants to the Released Parties and each of their respective designees the right to publicize such Prize Recipient’s name, address (city and state/province of residence), photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: The Challenge is a skill challenge designed to increase consumer awareness of and interest in MLS. This Challenge may not be used for any form of gambling. In the event that the Challenge is challenged by any legal or regulatory authority, the Sponsor or Tournament Operator reserves the right to discontinue or modify the Challenge, or to disqualify entrants residing in the affected geographic areas. In such event, Released Parties shall have no liability to any entrants who are disqualified due to such an action. Persons who tamper with or abuse any aspect of the Challenge or attempt to undermine the legitimate operation of the Challenge by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any Released Party’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor or Tournament Operator, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Challenge is unlawful and subject to legal action by the Released Parties. Prize Administrator shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Challenge, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York without giving effect to choice of law or conflicted law principles (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. Sponsor’s failure to enforce any terms of these Official Rules shall not constitute a waiver of that provision.
Tournament Organizer and the Prize Administrator, as applicable, reserve the right, in their sole discretion, to cancel or suspend the Challenge for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Challenge. In the event of cancellation, Tournament Organizer and Prize Administrator may elect to identify the Prize Recipients and award the Prize from among all non-suspect, eligible entries received up to the time of such cancellation.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, TOURNAMENT ORGANIZER WILL DISQUALIFY ANY SUCH ENTRANT, AND THE RELEASED PARTIES RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
SOCIAL MEDIA DISCLOSURE: This Challenge is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, Twitter, YouTube, Google or any other social media, mobile application, over-the-top application, or similar platform where this Challenge may be promoted, advertised or otherwise used to disseminate information relating to the Challenge. Each entrant understands that all information is being provided to the Released Parties and not to Facebook, Instagram, Twitter, YouTube, Google or any other social media where this Challenge may be promoted, advertised or otherwise used to disseminate information relating to the Challenge. The Released Parties are not responsible for practices, terms or actions taken by any of these or other social media and web services sites. Each entrant understands that they are required to comply with terms and conditions of those social media platforms.
WINNERS’ LIST: For a list of Prize Recipients (available after October 24, 2022), mail a self-addressed stamped envelope to: eMLS Amateur Cup Qualifier Prize Recipient’s List [Winner’s name, AS APPLICABLE] 420 5th Avenue, 7th Floor, New York, NY 10018. Prize Recipient’s list [name] requests must be received by November 30, 2022.
CHALLENGE ADMINISTRATORS:
· [Atlanta United FC] [1 AMB Drive NW, Atlanta GA 30313] is the sponsor of the Challenge.
· [Atlanta Untied FC] is the Prize Administrator.
· Tournament Operator will ensure compliance with these Official Rules and operation of the Challenge, including the matches. Tournament Operator will use Start.gg to operate the Challenge and issue the Official Rules.
· Major League Soccer, L.L.C., Soccer United Marketing, LLC, and each of the foregoing entities’ affiliated entities are not the sponsors, administrators, or the prize providers of this Challenge.
